These Terms & Conditions (“Terms”) govern your access to and use of weshopnepal.com and related applications, products, and services (collectively, the “Services”) provided by We Shop (“Weshop”, “we”, “us”, “our”). By using the Services, you agree to these Terms. If you do not agree, please do not use the Services.

1) Who we are & scope

Weshop operates an e-commerce platform focused on stationery and sports products in Nepal. We offer mobile number sign-up with OTP/password, easy variant selection, best-price listings, and options like Free Shipping (where eligible), Cash on Delivery (COD) and QR payments (via licensed partners).

2) Eligibility & account

  • You must be 18+ or have valid guardian consent and capacity to contract.
  • Create an account using your mobile number; you consent to receive OTP and transactional messages.
  • You are responsible for safeguarding your password/OTP and for all activity under your account.

3) Orders & contract formation

  • Your order is an offer to purchase products. Acceptance occurs when we dispatch items or explicitly confirm acceptance.
  • We may cancel/refuse orders due to stock limits, pricing errors, suspected fraud, or non-serviceable locations. Any paid amount will be refunded where applicable.
  • Electronic records and communications constitute valid contracts and notices.

4) Pricing, taxes & invoices

  • Prices may change over time. Apparent typographical errors may be corrected and affected orders cancelled/refunded.
  • Where applicable, VAT (13%) and other taxes/fees are shown at checkout. We issue a tax invoice for taxable supplies.
  • Final payable price appears at checkout, inclusive of shipping/surcharges if any.

5) Payments (COD & QR)

Cash on Delivery (COD)

  • Available for eligible orders/locations up to COD limit NPR 10,000.
  • We may verify orders by phone/SMS and may disable COD for repeated delivery refusals.

QR / Digital Payments

  • Processed by licensed PSPs/PSOs (e.g., interoperable Nepal QR). We do not store your card/wallet credentials.
  • Refunds are issued to the original method where possible; for COD, to your bank/wallet as provided.

6) Shipping, delivery & risk

  • We ship via partnered couriers. Free Shipping applies where shown; remote areas or oversized items may attract a surcharge.
  • Delivery timelines are indicative. Delays may occur due to courier capacity, weather, or regulatory checks.
  • Risk and title pass on delivery to your address or designated recipient.

7) Cancellations, returns & refunds

  • Cancel before dispatch from My Orders if available; after dispatch, use the returns process.
  • Return window: 7 calendar days from delivery, unless marked Non-returnable (e.g., opened pens/ink, hygiene/consumables, personalised items).
  • Items must be unused, in original packaging with all accessories and tags.
  • Refunds are initiated after QC of returns. Typical timelines: 3–7 business days post-approval.

8) Product info, availability & variants

  • We strive for accuracy in titles, descriptions, images, and variants (size/color/pack size), but minor differences can occur.
  • Stock is limited. If an item becomes unavailable post-order, we will cancel and refund.

9) Promotions, coupons & credits

  • Promos/coupons are time-bound, non-transferable, and may have exclusions or thresholds.
  • We may withdraw benefits obtained through misuse, manipulation, or policy violations.

10) Acceptable use

  • No payment abuse, chargeback fraud, coupon farming, or COD misuse.
  • No scraping, crawling, reverse-engineering, or service disruption.
  • No malware, unlawful/defamatory content, IP infringement, or fake reviews.
  • We may suspend/terminate accounts for violations.

11) User content & reviews

By posting reviews/photos/Q&A, you grant Weshop a worldwide, royalty-free license to use, reproduce, adapt, and display such content for operating and promoting the Services. We may moderate or remove content that is unlawful, misleading, or infringes rights.

12) Intellectual property

Site design, logos, graphics, software, and content are owned by or licensed to Weshop and protected by applicable IP laws. Do not use our IP without prior written consent.

13) Third-party services

We rely on third parties (couriers, payment processors, tax tools). Their services are subject to their own terms. We are not responsible for their acts or omissions.

14) Warranties & disclaimers

  • The Services and content are provided “as is” and “as available”.
  • No warranty of uninterrupted/secure access or error-free/complete content.
  • Manufacturer warranties (if any) apply as per their policy.

15) Limitation of liability

To the maximum extent permitted by law, Weshop will not be liable for any indirect, incidental, special, consequential, or punitive damages (including lost profits, data, or goodwill). Our aggregate liability for any claim is limited to the amount paid for the product(s) giving rise to the claim.

16) Indemnity

You agree to indemnify and hold harmless Weshop, its directors, employees, and partners from any claims, losses, liabilities, costs, and expenses (including legal fees) arising from your breach of these Terms, violation of laws/third-party rights, or misuse of the Services.

17) Privacy & communications

  • We process personal data (e.g., mobile number for OTP, addresses, order details) per our Privacy Policy and applicable Nepal laws.
  • You consent to transactional SMS/notifications (OTPs, order updates).
  • For marketing SMS/email/notifications, we obtain your opt-in and you can opt-out anytime.

18) Governing law & disputes

  • These Terms are governed by the laws of Nepal.
  • Courts at Kathmandu, Nepal shall have exclusive jurisdiction.
  • Please contact us first; we aim to resolve issues within 15 days of a written complaint.

19) Changes to Terms

We may update these Terms at any time. The revised Terms become effective upon posting with an updated “Last updated” date. Continued use constitutes acceptance.

20) Miscellaneous

  • Severability: If a clause is unenforceable, the remainder remains effective.
  • No waiver: Our failure to enforce a clause is not a waiver.
  • Assignment: We may assign our rights/obligations; you may not without consent.
  • Entire agreement: These Terms and our policies form the entire agreement.
